Terms of Service
Last updated: 10 June 2026
1. About these terms
This website, www.bowtelle.com (the “Site”), is operated by Bowtelle.
In these Terms of Service, “Bowtelle”, “we”, “us” and “our” refer to [insert legal entity or proprietor name trading as Bowtelle]. “You” and “your” refer to any person who visits the Site, creates an account or places an order with us.
These Terms of Service govern your use of the Site and your purchase of products from Bowtelle. By accessing the Site or placing an order, you agree to these terms together with our:
- Privacy Policy;
- Shipping Policy; and
- Returns Policy.
Please read these documents carefully before purchasing from us.
Nothing in these terms excludes, restricts or modifies any consumer right or guarantee that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
2. Our online store
Bowtelle offers womenswear and related products through the Site.
Our store is hosted by Shopify, which provides the ecommerce platform that enables us to display and sell our products.
You must not use the Site:
- for any unlawful, fraudulent or unauthorised purpose;
- in a way that infringes the rights of Bowtelle or another person;
- to introduce viruses, malicious code or other harmful material;
- to interfere with the operation or security of the Site; or
- to collect information from the Site through scraping, automated extraction or similar methods without our written permission.
We may suspend or restrict access to the Site where we reasonably believe these terms have been breached.
3. Eligibility to purchase
By placing an order, you confirm that:
- you are legally capable of entering into a binding agreement;
- you are at least 18 years old, or have the permission of a parent or legal guardian;
- the information you provide is accurate and complete; and
- you are authorised to use the payment method selected.
Products purchased from Bowtelle are intended for personal use unless we have agreed otherwise in writing.
We may limit or refuse orders that reasonably appear to have been placed for unauthorised resale or other commercial purposes.
4. Product information
We take reasonable care to ensure that product descriptions, measurements, fabric details, images and other information displayed on the Site are accurate.
However:
- colours may appear differently depending on your screen, display settings and lighting;
- natural fabrics may have slight variations in texture, weave or colour;
- garment measurements may vary slightly due to the nature of the fabric and production process; and
- styling items shown in photographs may not be included unless expressly stated in the product description.
These natural or minor variations are not necessarily faults.
You should review the product description, size guide and care information before placing an order. Please contact us before purchasing if you require further information about a garment.
We may correct genuine errors or update product information when required. Nothing in this section limits your rights where a product is materially different from its description or does not meet an applicable consumer guarantee.
5. Made-to-order garments
Bowtelle garments may be made to order in Sydney.
Where a product is made to order, the relevant product page or Shipping Policy will state the estimated production period. Unless otherwise stated, please allow up to two weeks for your garment to be made before dispatch.
Production and delivery timeframes are estimates rather than guarantees. We will contact you if we become aware of a material delay.
Because production may commence shortly after your order is accepted, made-to-order pieces may not be eligible for cancellation or change-of-mind returns once production has begun, except where required by law or otherwise stated in our Returns Policy.
This does not affect your rights in relation to faulty, damaged, incorrectly supplied or misdescribed products.
6. Prices and taxes
Unless otherwise stated, prices displayed on the Site are in Australian dollars.
Prices may be changed at any time before an order is placed. A price change will not affect an order that we have already accepted, except where there has been an obvious pricing error.
Applicable taxes will be displayed at checkout where relevant.
For international orders, you may be responsible for customs duties, import taxes, handling fees or other charges imposed by the destination country. These charges are not controlled by Bowtelle and are generally not included in the product or delivery price unless expressly stated.
7. Placing an order
When you submit an order, you are offering to purchase the selected products on these terms.
After your order is submitted, you should receive an email acknowledging that we have received it. This acknowledgement does not necessarily mean that your order has been accepted.
An order is accepted when we:
- confirm acceptance by email;
- begin production of a made-to-order garment; or
- dispatch the order,
whichever occurs first.
We reserve the right to decline or cancel an order before acceptance where reasonably necessary, including if:
- a product is unavailable;
- there is an obvious pricing or product information error;
- payment cannot be authorised;
- the order appears fraudulent;
- delivery cannot reasonably be made to the address supplied; or
- the order breaches these terms.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled item or order.
8. Payment
Payment must be made using one of the payment methods offered at checkout.
Payments are processed through third-party payment providers. Bowtelle does not generally receive or store your complete credit or debit card information.
You are responsible for ensuring that your billing and payment information is accurate and that sufficient funds are available.
We may carry out reasonable verification or fraud-prevention checks before accepting or dispatching an order.
9. Shipping and delivery
Shipping options, charges and estimated delivery periods are provided at checkout or in our Shipping Policy.
Once a made-to-order garment has been completed and dispatched from Sydney:
- Australian deliveries will typically arrive within 5–7 business days; and
- international deliveries may take approximately 7–16 business days.
These timeframes are estimates and may be affected by carrier delays, customs processing, public holidays, severe weather or other circumstances beyond our reasonable control.
You are responsible for providing a complete and accurate delivery address. Bowtelle is not responsible for delays or additional costs caused by incorrect or incomplete information supplied by you.
Tracking information will be provided where available.
Risk in the products passes to you upon delivery to the address provided, subject to any rights you have under applicable law.
10. Returns, exchanges and faulty products
Returns and exchanges are governed by our Returns Policy, which forms part of these terms.
We are not required to provide a refund or exchange simply because you change your mind, unless our Returns Policy provides otherwise.
However, products sold by Bowtelle come with consumer guarantees that cannot be excluded under the Australian Consumer Law.
Depending on the circumstances, you may be entitled to a repair, replacement, refund or other remedy where a product:
- is faulty;
- is unsafe;
- is not of acceptable quality;
- does not match its description;
- is not fit for a purpose made known to us; or
- is otherwise supplied in breach of an applicable consumer guarantee.
Your rights under the Australian Consumer Law apply independently of any change-of-mind policy or stated return period.
Please contact [insert customer service email] as soon as reasonably possible if you believe there is a problem with your order.
11. Order details and customer accounts
You agree to provide current, complete and accurate information when placing an order or creating an account.
You are responsible for:
- maintaining the confidentiality of your account login details;
- activity occurring through your account; and
- promptly updating information that changes.
Please contact us if you believe your account has been accessed without authorisation.
We may suspend or close an account where reasonably necessary to protect you, Bowtelle or other users from fraud, misuse or security risks.
12. Promotions and discount codes
Promotions and discount codes may be subject to additional conditions stated at the time they are offered.
Unless expressly stated otherwise:
- promotional codes cannot be exchanged for cash;
- only one promotional code may be used per order;
- promotional codes cannot be applied retrospectively;
- offers are subject to availability; and
- promotions may be changed or withdrawn before an eligible order is placed.
Nothing in this section permits us to withdraw or alter a promotion after we have accepted a qualifying order, except to correct an obvious error or address fraud or misuse.
13. Intellectual property
All content appearing on the Site, including Bowtelle’s name, branding, logos, garment designs, photographs, graphics, text, layouts and other material, is owned by or licensed to Bowtelle and is protected by applicable intellectual property laws.
You may access and use the Site for personal, non-commercial shopping purposes.
You must not, without our prior written permission:
- copy, reproduce or republish Site content;
- use our images or product descriptions commercially;
- modify or create derivative works from our content;
- use Bowtelle’s branding in a way that suggests endorsement or affiliation; or
- exploit any part of the Site or its content for commercial purposes.
14. Reviews, feedback and submissions
If you submit a product review, photograph, comment or other content to Bowtelle, you confirm that:
- you created the content or have permission to submit it;
- the content is accurate and not misleading;
- it does not infringe another person’s rights;
- it is not unlawful, abusive, defamatory or harmful; and
- it does not contain malicious code.
You retain ownership of your content.
By submitting content for publication, you grant Bowtelle a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for purposes connected with our business, products and marketing.
We will not be required to publish submitted content and may remove content that breaches these terms.
15. Third-party services and links
The Site may contain links to websites or services operated by third parties, including payment, social media, delivery and technology providers.
Those services are governed by the third party’s own terms and privacy practices. Bowtelle does not control third-party websites and is not responsible for their content, availability or practices.
A link to another website does not necessarily mean that Bowtelle endorses that website or its products or services.
16. Privacy
Our collection, use and disclosure of personal information are governed by our Privacy Policy.
By using the Site, you acknowledge that personal information may be processed by Shopify and other service providers involved in operating our store, processing payments, communicating with customers and delivering orders.
17. Site availability and errors
We aim to keep the Site accurate, secure and available. However, we cannot guarantee that access will always be uninterrupted or error-free.
We may temporarily suspend, restrict or modify parts of the Site for maintenance, security, operational or technical reasons.
From time to time, the Site may contain an obvious typographical, technical, pricing or availability error. We may correct such errors and, where necessary, contact you regarding an affected order.
We will not cancel an accepted order merely because we later decide that the agreed price was commercially unfavourable.
18. Liability
Nothing in these terms excludes, restricts or modifies:
- your rights under the Australian Consumer Law;
- liability that cannot lawfully be excluded; or
- any other mandatory right or remedy available to you.
To the maximum extent permitted by law, Bowtelle is not responsible for indirect or consequential loss arising solely from your use of the Site, where that loss was not reasonably foreseeable.
To the extent permitted by law, we are not responsible for loss caused by:
- your misuse of a product;
- your failure to follow garment care instructions;
- inaccurate information supplied by you;
- unauthorised access resulting from your failure to protect account details; or
- events outside our reasonable control.
Any limitation in these terms applies only to the extent permitted by applicable law.
19. Events beyond our reasonable control
Bowtelle will not be responsible for delay or failure caused by circumstances outside our reasonable control, including natural disasters, severe weather, transport disruption, industrial action, government restrictions, widespread network failure or significant interruption to suppliers.
Where such an event affects an accepted order, we will take reasonable steps to minimise the impact and communicate material delays to you.
Your rights under applicable consumer law remain unaffected.
20. Suspension and termination
You may stop using the Site at any time.
We may suspend or terminate your access to the Site where we reasonably believe that you have:
- breached these terms;
- engaged in fraudulent or unlawful conduct;
- interfered with the operation or security of the Site; or
- misused Bowtelle’s content, systems or services.
Termination does not affect rights or obligations that arose before termination.
21. Changes to these terms
We may update these Terms of Service to reflect changes to our products, services, business practices or legal obligations.
The latest version will be published on this page with an updated date.
Changes will apply from the date they are published and will not retrospectively alter an order that we have already accepted, unless required by law or agreed with you.
22. Severability
If any part of these terms is found to be invalid, unlawful or unenforceable, that part will be read down or removed to the minimum extent necessary.
The remaining provisions will continue to apply.
23. No waiver
If Bowtelle does not immediately enforce a right under these terms, that does not mean we have waived that right.
Any waiver must be given expressly and applies only to the specific circumstances in which it is given.
24. Entire agreement
These Terms of Service, together with the policies expressly incorporated into them, form the agreement between you and Bowtelle concerning your use of the Site and purchases made through it.
They do not exclude any representations, rights or remedies that cannot lawfully be excluded.
25. Governing law
These terms are governed by the laws of New South Wales, Australia.
You and Bowtelle submit to the courts and tribunals of New South Wales and any courts entitled to hear appeals from them.
Nothing in this section prevents you from exercising a right available under applicable consumer law in another jurisdiction.
